This is a completely different scenario. The Patriots gave the Jets permission to tape, most likely, and the Jets weren't exactly taping signals from the opposite sidelines, which means they weren't breaking the same rule even if the Pats didn't give permission to tape.

But what happened there was the Pats caught the Jets taping signals under the pretext of getting game film, and the Pats did what's usually done in the NFL: they said "hey, caught you, cut it out for this game," and the Jets did. End of story.

The timing of this report is a complete mindgame, by the by.

Sadly, adverse weather will probably prevent the game from being the 4000-3 affair Belichick probably would like it to be.
